$500 million fine for AU Optronics in price fixing scandal (2012/09/21)

台灣第二大面板製造商友達，被美國聯邦法官認定，和同業共謀操控面板價格。美國地方法院在台灣時間21日凌晨宣判，裁罰友達5億美元，約新台幣146.6億元，追平單一企業壟斷罰金最高紀錄。法官還判處兩名前友達主管陳炫彬和熊暉3年徒刑，並各罰20萬美元。

走出加州地方法院，前友達總經理陳炫彬和前執行副總熊暉面色凝重，不願多說。由於法官裁定，台灣友達光電和同業共謀操控面板價格，判處兩人各3年徒刑，並各罰20萬美元；至於友達公司則被裁罰5億美元，追平單一企業壟斷罰金的最高紀錄。

對於法官的裁定，友達很難接受，台灣總公司也在第一時間，出面說明。

“今年三月份的判決其實，讓兩位主管是無罪，已經突顯陪審團其實在這個案子裡面，判決結果並不一樣，未來的上訴的過程，還能有更多爭取，更合理對待的機會”

不過想爭取這機會，代價也不小。

“過去已經提列2.77億美金，因為今天這個判決是5億美金，所以公司會在這個季度，另外再提列2.23億美金左右的金額，作為額外訴訟準備”

裁定消息傳出，也讓已經連跌兩天的友達股價；21日反而因為利空出盡，收盤大漲了5%。

Taiwan's second-largest panel maker AU Optronics faces a half billion U.S. dollar fine after it was found guilty of price fixing in a U.S. district court. Two executives were also sentenced to jail time, but the company plans to appeal. 

A U.S. district court in California found former AUO President Chen Hsuan-bin and former Executive Vice President Hsiung Hui guilty of price fixing. Both defendants had little to say after the verdict was read. The judge ruled Taiwan's AU Optronics and peers conspired to manipulate panel prices, sentencing both to three years in prison along with a fine of US$200,000 apiece. Also AUO faced a fine of US$500 million, tying the highest single fine an enterprise has faced for operating an illegal monopoly.

To what extent American anti-trust law applies to a Taiwanese corporation. We will be raising this on appeal, so the case is far from over. 

AUO is finding it difficult to accept the judge's decision, with the company’s headquarters stepping forward to respond to the ruling.

The court ruled in March this year, and acquitted two managers, underscoring the fact that the jury reached a different verdict this time. We will seek a more reasonable ruling in appeals. 

Many believe that AUO will ultimately pay a big price.

We already set aside US$277 million, but because today's judgment was US$500 million, this quarter we will have to provide another US$223 million as additional provisions for this lawsuit.

AUO’s share price has fallen for the past two days, but today it rose by 5 percent.
